These Terms and Conditions govern access to and use of the Attend website, mobile and web application (the “App”), and related services, operated by Attend, Inc.
1. Overview of Services
Attend provides subscription-based and on-demand home care, maintenance coordination, and concierge services. The App serves as a communication, scheduling, and record-keeping tool between Members and the Attend team.
Services include:
- Home maintenance and repair coordination
- Preventive inspections and service recommendations
- Appointment scheduling and service requests
- Storage of home system, equipment, and service records
- Communications, notifications, and service updates
2. Eligibility and Accounts
Users must be at least 18 years old and legally capable of entering binding contracts. Account holders must provide accurate information, maintain credential confidentiality, and accept responsibility for account activity. Attend disclaims responsibility for unauthorized access resulting from credential mismanagement.
3. Memberships, Subscriptions, and Payments
Paid memberships require fee disclosure at signup. Subscriptions automatically renew unless canceled. Attend may modify pricing or offerings with advance notice. Non-payment may result in service suspension or termination.
4. The Attend App and Digital Records
4.1 Purpose of the App
The App functions as a centralized communication and organizational tool, storing home system information, maintenance history, photos, notes, and appointment communications.
4.2 No Guarantee of Accuracy
“Information in the App may be based on user input, third-party data, or service observations. It may be incomplete or outdated and should not replace manuals, inspections, or professional advice.” Users remain responsible for verifying critical home and safety information.
5. Privacy and Data Use
Service use is governed by Attend’s Privacy Policy. Users consent to collection, processing, and storage of necessary information for operations and service-related communications.
Apple-Required Privacy Acknowledgment: Attend, not Apple, handles personal data collected through the App. Apple bears no responsibility for data practices.
6. Service Providers and Scope of Responsibility
Attend may perform services directly or coordinate third-party professionals. “Attend does not guarantee service outcomes, timing, or availability.” Third-party providers operate under their own licenses and terms. Attend disclaims responsibility for pre-existing conditions, manufacturer defects, concealed issues, and does not provide architectural, engineering, legal, or inspection services.
7. User Responsibilities
Users must provide safe property access, disclose known hazards, use Services lawfully, and refrain from interfering with or misusing the App or Services. Attend may refuse service if conditions are unsafe or non-compliant.
8. Intellectual Property
All content, software, trademarks, and materials are owned by Attend or its licensors. Users may not copy, modify, distribute, reverse engineer, or exploit Services without written permission.
9. No Warranties; Service Limitations
“Services are provided ‘as is’ and ‘as available.’” Attend disclaims all warranties, including implied merchantability and fitness warranties. “Attend does not guarantee that Services will prevent all failures, damage, or emergencies.”
10. Limitation of Liability
“Attend is not liable for indirect, incidental, consequential, or punitive damages.” Attend’s liability cap equals amounts paid by the user in the preceding twelve months. Jurisdictional limitations may apply.
11. Indemnification
Users indemnify Attend and affiliates from claims arising from Service use, Terms violations, or applicable law violations.
12. Suspension and Termination
Attend may suspend or terminate access for Terms violations, non-payment, or legal/safety/operational reasons. Users may cancel memberships per applicable terms.
13. Changes to Terms or Services
Attend may modify Terms anytime. Updates appear with revised dates. Continued Service use constitutes acceptance of changes.
14. Governing Law and Dispute Resolution
Terms are governed by the state where Attend is headquartered. Disputes resolve through binding arbitration or competent courts.
15. App Store and Platform-Specific Terms
15.1 Apple App Store Terms
Terms apply between users and Attend, not Apple. Apple provides no App warranty beyond purchase refunds. Attend addresses all App-related claims. Apple is a third-party beneficiary and may enforce these Terms.
15.2 Google Play Store Terms
Terms apply between users and Attend, not Google LLC. Use is subject to Google Play’s Terms of Service. Google bears no App responsibility.
16. Third-Party Services and Devices
The App may integrate with third-party platforms or devices. “Attend is not responsible for third-party availability, functionality, platform changes, or privacy practices.”
17. App Availability, Updates, and No Emergency Use
Attend provides no uninterrupted availability or device compatibility guarantees. “The App is not intended for emergency or safety-critical use.” Users should contact appropriate services for emergencies.
