These Terms and Conditions (“Terms”) govern your access to and use of the Attend website, the Attend mobile and web application (the “App”), and all related services (collectively, the “Services”), which are operated by Attend, Inc. (“Attend,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.
1. Overview of Services
Attend provides subscription-based and on-demand home care, maintenance coordination, and related concierge services. Attend also provides a digital platform (the App) used primarily as a communication, scheduling, and record-keeping tool between Attend members (“Members,” “you,” or “your”) and the Attend team.
Services may include, but are not limited to:
• Home maintenance and repair coordination
• Preventive inspections and service recommendations
• Appointment scheduling and service requests
• Storage of home system, equipment, and service records
• Communications, notifications, and service updates
Specific services, pricing, inclusions, and exclusions vary by plan, location, and availability and are disclosed at enrollment.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding contract. To use certain features, you must create an account. You agree to provide accurate and current information, maintain the confidentiality of your login credentials, and accept responsibility for all activity under your account. Attend is not responsible for unauthorized access caused by your failure to safeguard credentials.
3. Memberships, Subscriptions, and Payments
Some Services require paid memberships or subscriptions. Fees and billing terms are disclosed at signup. Subscriptions may automatically renew unless canceled. Attend may modify pricing or service offerings with advance notice. Failure to pay may result in suspension or termination of Services.
4. The Attend App and Digital Records
4.1 Purpose of the App
The App functions as a centralized communication and organizational tool and may store home system information, maintenance history, photos, notes, and appointment communications.
4.2 No Guarantee of Accuracy
Information in the App may be based on user input, third-party data, or service observations. It may be incomplete or outdated and should not replace manuals, inspections, or professional advice. You remain responsible for verifying critical home and safety information.
5. Privacy and Data Use
Your use of the Services is governed by Attend’s Privacy Policy. By using the Services, you consent to the collection, processing, and storage of information necessary to operate the Services and to communications related to service delivery and account management.
Apple-Required Privacy Acknowledgment: Attend, not Apple, is responsible for handling any personal data collected through the App. Apple has no responsibility for the App’s data collection or use practices.
6. Service Providers and Scope of Responsibility
Attend may perform services directly or coordinate third-party professionals. Attend does not guarantee service outcomes, timing, or availability. Third-party providers may operate under their own licenses, insurance, and terms. Attend is not responsible for pre-existing conditions, manufacturer defects, or concealed issues and does not provide architectural, engineering, legal, or inspection services.
7. User Responsibilities
You agree to provide safe access to your property, disclose known hazards, use Services lawfully, and not interfere with or misuse the App or Services. Attend may refuse service if conditions are unsafe or non-compliant.
8. Intellectual Property
All content, software, trademarks, and materials are owned by Attend or its licensors. You may not copy, modify, distribute, reverse engineer, or exploit the Services without written permission.
9. No Warranties; Service Limitations
Services are provided “as is” and “as available.” Attend disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Attend does not guarantee that Services will prevent all failures, damage, or emergencies.
10. Limitation of Liability
To the fullest extent permitted by law, Attend is not liable for indirect, incidental, consequential, or punitive damages. Attend’s total liability shall not exceed the amount paid by you to Attend in the twelve (12) months preceding the claim. Some jurisdictions may limit these exclusions.
11. Indemnification
You agree to indemnify and hold harmless Attend and its affiliates from claims arising out of your use of the Services, your violation of these Terms, or your violation of applicable laws or third-party rights.
12. Suspension and Termination
Attend may suspend or terminate access for violation of these Terms, non-payment, or for legal, safety, or operational reasons. You may cancel your membership pursuant to applicable cancellation terms.
13. Changes to
Terms or Services
Attend may modify these Terms at any time. Updates will be posted with a revised “Last Updated” date. Continued use of the Services constitutes acceptance of revised Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state in which Attend is headquartered. Disputes shall be resolved through binding arbitration or courts of competent jurisdiction, as determined by Attend.
15. App Store and Platform-Specific Terms
15.1 Apple App Store Terms
These Terms are between you and Attend, not Apple Inc. Apple is not responsible for the App, its content, or support. Apple provides no warranty for the App beyond refunding the purchase price, if applicable. Attend is solely responsible for addressing claims relating to the App. Apple is a third-party beneficiary of these Terms and may enforce them.
15.2 Google Play Store Terms
These Terms are between you and Attend, not Google LLC. Your use is subject to Google Play’s Terms of Service. Google bears no responsibility for the App or its content.
16. Third-Party Services and Devices
The App may integrate with third-party platforms or devices. Attend is not responsible for third-party availability, functionality, platform changes, or privacy practices.
17. App Availability, Updates, and No Emergency Use
Attend does not guarantee uninterrupted availability or compatibility with all devices. The App is not intended for emergency or safety-critical use. For emergencies, contact appropriate services directly.
